Artwork Terms of service

Terms are subject to change without notice. When commissioning, you are agreeing to the terms present at the time of your commission.

You must agree to these terms to commission Inktooth. Inktooth assumes all clients have read the terms below; if the client does not read the terms, they are still required to follow them. Inktooth is not responsible for a client's failure to read the terms.

Openings

Openings are typically announced via social media platforms (Twitter, Facebook, Telegram, etc). 
Commissions are not first come first serve. We select projects based on what we feel we can work best with. We typically look for applications with clear references, proper contact information, and themes and designs that suit our style.

The Commissioning Process

When Inktooth opens for commissions, our commission forms go live. While forms are live, the client will fill out the appropriate form and submit it. If Inktooth selects you, we will contact you to confirm. Once confirmed, we will send an invoice to the PayPal address provided in the form submitted. 

Acceptable Themes

Inexperienced With:
  • Mechanics & machines
  • Landscapes
Will Not Draw:
  • Fetish themes
  • NSFW
  • Hate imagery (racism, homophobia, Nazi, etc)
  • Copyrighted characters
  • Targeted hate art
  • Tracing or mimicking another artist

Payment

  • Inktooth typically accepts payment via Paypal and Square. You do not need an account on either to work with us - you only need a contact email and a credit or debit card.
  • Cash is only accepted at conventions.
  • ​All prices are in USD.
  • Inktooth requires full payment before we begin work on art commissions. We will not begin or schedule your commission until the payment has processed. If your commission is chosen, we will send an invoice to the email provided to us by the client in the form. The client is to pay the invoice within 48 hours unless otherwise specified (if you need an extension, please notify us immediately so we can work with you). If the client fails to pay the invoice, their slot is forfeited. 
  • Payment plans are available for commissions over $100. A minimum of $50 is due every two weeks. If the client misses more than two payments in a row, the commission will be cancelled and the client will be refunded the amount they've paid, minus 10% of the sum paid up to the point of cancellation, for reserving the queue slot. 
  • Tips are never required, but always appreciated! If you choose to tip, you may either do so directly on the invoice, or you can tip after completion by sending a gift payment to our Paypal. You can also use our Ko-fi.

Client Rights

  • You may only repost our artwork if you are the client for that particular piece, the image contains our watermark or signature, and you must link back to inktooth.net 
  • You may not remove our name, watermark, or signature from a piece. 
  • You may crop the artwork to use as an icon or banner.
  • You may not mass produce the artwork or profit from it unless otherwise discussed with Inktooth.
  • You may not edit the artwork (besides cropping). If you would like an edit, please contact Inktooth for permission, or to request the edit be done by us.
  • You may not trace or draw over our work.
  • You may not claim our work as your own work.

Refunds

  • Inktooth has the right to cancel and refund a commission for any reason.
  • A full refund will be provided upon request if we have not begun your commission.
  • If we have begun work on your commission, a partial refund will be made based on the amount of work completed.
  • If you have requested a refund, you may not jump back into the queue ahead of the next opening - you will need to reapply.
  • Lost contact may result in a refund. Any work completed will be reused and resold.
  • Refunds will not be issued on completed works.

Discounts

  • Inktooth may offer discounts occasionally and they will be announced publicly as well as posted on our commission page.
  • Certain Patreon tiers include discounts! Please see our Patreon for more information.

Correspondence

  • If you have any questions or concerns, send us an email at inktooth@yahoo.com and we will get back to you right away! You may also contact us on social media or other websites we are on, but we may be a little slower to respond, as we do not check them as often.
  • Please do not message us on instant messaging platforms unless we give you the OK to do so. We typically use these for work at conventions, so it can get confusing to us if we get messages outside of that.
  • It is imperative that you include a working contact in the commission form. If we can't contact you, we can't do your commission! Please notify us of any change in contact information as soon as possible.
  • If you require a change to your commission, please notify us immediately!

Queue & Schedule

  • Once your payment for your commission has cleared, you will be placed on our queue and we will schedule your project on our calendar.
  • Our queue and calendar is public! Access it with the button below.
  • Let us know ahead of time if you need your piece by a certain date. A rush fee of 35% may be applied if we have to alter our current schedule to meet the deadline.
Calendar & Queue

Work-In-Progress & Updates

  • We will send you a sketch so that you can confirm that everything is correct before we move on. If you need edits or changes, this is where you should tell us that.
  • Additional WIPs may be sent at various stages. If at any time you would like a WIP, simply contact us and ask!
  • Major edits requested after the coloring phase may result in a small fee based on the amount of work. The fee will need to be paid before the edits are made.
  • If an edit needs to be made and it's our fault (ex. we missed a detail, got a color wrong, etc) the edit will always be made for free.
  • Inktooth does not supply working files to clients (such as .PSD files)

Artist Rights

  • Inktooth may reject or terminate a commission or sale for any reason.
  • Inktooth retains all copyrights over their work, including, but not limited to the right to distribute, reproduce, copy, and use the image for self-promotion. Inktooth will never resell or rework a completed work without the original client's consent.

Gifts

  • If you are purchasing art as a gift for someone else, Inktooth requires permission from the owner of the character you are commissioning us to draw.
  • If the characters requested have preexisting art together, or if the owners are prominently featured on each others profiles, or otherwise obviously have a good relationship together, the above point may be skipped.

Chargebacks

  • If there is a problem with your commission, please let us know so we can rectify it right away.
  • In the event of a chargeback, any work done will be reused or resold, and the client forfeits any rights or claim over the work.

Commission Type Specifics

Designs and Adoptables

  • Inktooth may re-use any rejected designs or features.
  • When you purchase a design from Inktooth, you are purchasing partial rights to the design. We retain all rights to the intellectual property, but we will never reuse or resell the design sold for commercial purposes.
  • You may only repost our artwork of the design if the image contains our watermark or signature, and you must link back to inktooth.net 
  • Reselling a design made for you is allowed. You may resell for whatever amount you wish. There is no need to contact Inktooth prior to the sale.
  • Trading a design is allowed. You may trade for anything you wish, including physical items or vouchers. There is no need to contact Inktooth prior to a trade.
  • You may edit your design as much as you like, but you may not edit our artwork. Do not claim the edited version as entirely your own creation.
  • You may co-own a design with somebody, however Inktooth will not get involved in disputes.
  • Adding on rules (such as "return to the previous owner") is prohibited. Inktooth's Terms of Service trumps such rules.

Telegram Stickers

  • A client who commissions Telegram stickers must add Inktooth's credit sticker to their sticker pack.
  • The client will receive the individual files for each sticker.
  • The client may upload the stickers to any messenger app.
  • The client may use the stickers as they please for personal use as long as the artwork is not edited.
  • The client may not put the sticker pack up for sale or purchase anywhere.

Bases/Lineart

  • Free & "Pay to Use" bases are available for public use.
  • You may not distribute "Pay to Use" bases to anyone.
  • You may color bases for personal use.
  • You may sell adoptables on the bases for any currency.
  • You may not sell or trade the bases themselves.
